We are a standard party supply rental company that will be involved in renting out tables, chairs, flatware, linens, centerpieces, stages, tents, red carpet, mobile bar, coolers, plates, glasses, cutleries and other items for public and private parties and events. We will engage in business activities such as tentage rentals, wedding rentals, mobile bar rentals, birthday rentals, red carpet rentals, corporate event rentals, banquets and other event rentals.
A tables and chairs will make an instant impression for any event. All our tables and chairs for party rentals are maintained to the highest conditions possible to ensure optimal form and function for our customers.

RENTAL FORM AGREEMENT:
General Release/indemnity/hold/harmless:I understand and acknowledge that the use of a table/chair/tent entails both known and unknown risks including, but limited to, physical injury from falling, slipping, crashing or colliding, emotional injury, paralysis, distress, damage or death to any participants. I hereby voluntarily and expressly release, indemnity, forever discharge and hold harmless KIDZ at PARTYSHOP, (“KPS,”) and any of its officers, directors, employees, or agents, from any and all liability, claims, demands, causes or rights of action whether personal to me or to a third party, which are in any way connected with participation inthis activity, including those allegedly attributable to negligent acts or omissions. ShouldKPSor anyone acting on behalf ofKPSbe required to incur attorney's fees and costs to enforce this Agreement, I expressly agree toindemnify and holdKPSharmless for all such fees and costs. In the event I, the undersigned, or any of my participants file a lawsuit againstKPS, it is agreed to do so solely in City ofBiñan Laguna, Philippines. I agree that if anyportion of thisAgreementis found to be void or unenforceable,the remaining portions shall remain in full force and effect. In consideration of being permitted byKPSto use itsproductsand facilities, the undersigned and itsparticipants agree to indemnify and hold harmlessKPSfrom any and all claims which are brought by theundersigned and/or their participants and which are in any way connected with such use or participation.
ItemsforRent, Payment, and TermsofRentalAgreement:Customer rents fromKPScertain productsdescribed on the invoice sectionof thisAgreement. TheRentalfee set forth is payable, in full,at the timetheAgreementis signed.When theitems are delivered byKPSand accepted by Customer,theCustomer shall not be entitled to any refund whatsoever if Customer elects not to use the itemsdue to weather orother causes.
Returned Check policy:In the event that a check is returned toKPSfor insufficient funds,customeragrees to pay the totalRentalprice as well as an additional ₱150.00 fee toKPSin cash immediately uponnotice.
Weather:KPScannot guarantee weather conditions;we reserve the right to cancel or reschedule yourRentalprior to delivery if severe weather conditions are imminent or if we have reason to believe that itsusers may be in danger. Tentcannot be setup in high winds (over 15mph).If cancellations arenecessary due to severe weather conditions,KPSwill issue a refund within 30 days if the customer does not elect to reschedule.
Delivery:KPSstaffwill deliver theRentalItemsto the specified area of apermittedevent atKPS.Customer will ensure to have a designated representative to oversee unloading ofRental Itemsandplacement.At the time of pickup an inventoryand inspectionof all items will be takenbyKPSstaff.
Receipt/inspection ofRentalItems: Customer hires theRentalItemson an "as is" basis. Customeracknowledgesresponsibility ofinspectingtheRental Itemsprior to its use.
Possession/Title: Customersright to possession of theRental Itemsbegins upon the items beingdelivered toidentified spaces atKPS. Retention of possession, orany failure to permit the pickup of theitem(s) at or after the end of the "RentalPeriod" specified constitutes a material breach of thisAgreement. Title to theRental Itemsis and shall remain inKPS’sname. Customer agrees tokeep theRentalItems in his/her/their custody and control from the time ofKPS’sdelivery of the items, untilKPSpicks up such items. Customer shall not cause nor permit these items, or any of them, to be sublet, rented, sold, or removed, or otherwise transfer such items. IfRental Itemsare not returned and/or leviedupon for any reason whatsoever,KPSmay retake possession of said items without further notice or legal process and use whatever force is reasonably necessary to do so. Customer hereby agrees to indemnify,defend, and holdKPSharmless from any and all claims and costs arising from such retaking and/orlevy.IfRental Itemsare levied upon, or otherwise moved Customer shall notifyKPSimmediately.
Care of the RentalItems: Customer shall be responsible for any and all damage to any of theRentalItemsnot caused by ordinary wear and tear. "Ordinary wear and tear" shall mean only the normal deteriorationof theRental Itemscaused by ordinary, reasonable and proper use of the Rental Items. Damage which isnot "ordinary wear and tear" includes, but is not limited to, cutting or tearing of vinyl, bending/breakingof poles or stakes, damage due to overturning, overloading, exceeding rated capacities, breakage, improper use, abuse, lack of cleaning, contamination of or dirtying ofRental Itemswith non-approveditems such as chemicals, non-approved food, paint, silly string,mud, clay, or other materials.Customerwill clean all tables and chairs at the completion of the event.A ₱500.00 cleaning fee may be imposed iftables and chairs are not cleaned prior to beingpicked up byKPS.All tables MUST be protected by a tablecloth or table covering.
Should anyitemdevelop a problem, or does not function correctly at anytime, orCustomer does notunderstand the operating Instructions,Customer agrees to immediately cease use of thatitem.LimitedWarranty:KPSwarrants that theRentalItems leased under thisAgreementwill be in good workingorder when delivered. Allitems aresupplied and maintained subject solely to this warranty.KPSmakesno warranty of merchantability or fitness for any particular use or purpose, either expressed or implied. There is no warranty or representation that theRentalitem willfittheCustomer's particular intended use, or that it is free of latentdefects.KPSshall not be responsible to Customer or to any third party forany loss, damage, or injury resulting from, or in anyway attributable to the operation of, installation of,use of, or any failure of the Rental Items.KPSshall not be responsible for any defect or failure unknowntoKPSat the time of delivery.
Additions and CancellationsPolicy:Customer will receive afull refund if this Agreement iscancelledin writingat least60days prior to rental date.Additions maynotbe made to this original Agreement at any time later than 15 days prior to rental date. Invoice for additional items will be made by modifying original Agreement. Both parties will initial changes and Customer will submit additional payment due immediately.
Compliance with Laws: Customer agrees not to use or allow anyone to use theRentalItemsfor any illegalpurpose or in any illegal manner or in an unsafe manner. Customer agrees at his/her/their sole cost and expense to comply with all citygovernment ordinanceor other governmental or quasi-governmental laws, ordinances, permitsand/or regulations which may apply to the use of theRental Itemsduring theRentalperiod. Customer further agrees to pay all licenses, fines, fees, permits, or taxes arising from Customer'suse of the Rental Items, including any subsequently determined to be due.Customer is solely responsiblefor obtaining any/all permits and/or licenses from the appropriate government agencies prior to use.
Legal Fees: Any dispute involving this Agreement or any permit issued thereafter shall be resolved only through mediation and arbitration proceedings. Venue of all disputes shall only be in Biñan Laguna, Philippines. The dispute shall first be submitted to mediation process at the (Barangay Justice Systems) before a regular judicial system of the Philippines. If an impasse is declared, then the dispute shall be submitted to binding arbitration before an arbitrator mutually selected by the parties and KPS. Attorneys’ fees shall not be awarded to either party.
Customer Acknowledgment: Customer acknowledgesand certifies that they have had a sufficient opportunity to read this entire Agreement, and agree to be bound by all the terms and conditions on allpages and that they understand its contentand that they execute it freely, intelligently and withoutduress of any kind.
Severability: If any of the terms or conditions of thisAgreementare found to be unenforceable, illegal orunconscionable by a court of competentjurisdiction, such item shall be stricken from thisAgreement, andthe remaining terms and conditions of thisAgreement shall stay in full force and effect.
Entire Agreement: ThisAgreementconstitutes the fullAgreementbetweenKPSand Customer. Any priorAgreements, whether written or oral, promises, negotiations or representations not expressly set forth herein shall be of no force or effect. Customer acknowledges the receipt of theRentalAgreement.
I HAVE READ AND UNDERSTAND THE TERMS AND CONDITIONS OF THIS AGREEMENT, AND AGREE TO BE BOUND BY THEM. I FURTHER WARRANT AND REPRESENT THAT I AM THE CUSTOMER AND AUTHORIZED TO EMPOWERED AND ACCEPT DELIVERY OF THE ITEMS AND TO SIGN THIS AGREEMENT.
